1. Our Mission & Intended Use of Products

1.1 Intended Use

All products sold by Dome Guys (Mauritius) Ltd are designed and intended exclusively for the following lawful purposes:

• Commercial Agriculture: Professional plant nurseries, greenhouses, and farming operations
• Off-Season Cultivation: Year-round growing of vegetables, herbs, fruits, and ornamental plants using controlled environment agriculture (CEA) techniques
• Home Gardening: Indoor and outdoor gardening for personal food production and hobby cultivation
• Sustainable Living: Supporting self-sufficiency through home-grown produce, reducing reliance on imports, and promoting food security
• Education & Research: Agricultural education, horticultural research, and training programmes
• Geodesic Structures: Eco-friendly dome structures for agricultural, hospitality, and residential use

1.2 Prohibited Use

Customers are strictly prohibited from using any products purchased from Dome Guys (Mauritius) Ltd for any illegal or unlawful activity. This includes, but is not limited to:

• The cultivation, production, processing, or distribution of any controlled or prohibited substances under the laws of the Republic of Mauritius or any other jurisdiction
• Any activity that violates the Dangerous Drugs Act 2000 of Mauritius or any subsequent amendments thereto
• Any activity that contravenes local, national, or international laws and regulations

Dome Guys (Mauritius) Ltd reserves the right to refuse sale to any individual or entity where there is reasonable suspicion that products may be used for unlawful purposes.

1.3 Customer Declaration

By purchasing any product from Dome Guys (Mauritius) Ltd, the customer hereby declares and warrants that:

• The products will be used solely for lawful agricultural, horticultural, or gardening purposes
• The customer is of legal age (18 years or older) to make the purchase
• The customer will comply with all applicable laws and regulations in relation to the use of the purchased products
• The customer accepts full responsibility for the use of the products after purchase

2. Acceptance of Terms

Welcome to Dome Guys (Mauritius) Ltd. By accessing our website, requesting a quote, or purchasing any of our products and services, you agree to be bound by these Terms & Conditions ("Terms").

If you do not agree to these Terms, please do not use our website or services and do not make any purchases.

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Dome Guys (Mauritius) Ltd ("Company," "we," "our," or "us"), a company registered in the Republic of Mauritius under BRN C18156896.

4. Products & Services

We provide the following products and services:

4.1 Geodesic Dome Structures

• Design, manufacture, and sale of geodesic dome structures for agriculture, hospitality, and residential use
• Consultation and site assessment services
• Professional installation and setup
• Customization and additional features (furniture, electrical, plumbing, etc.)

4.2 Horticultural Equipment

• LED grow lights for indoor plant cultivation (Spider Farmer, and other brands)
• Ventilation and air circulation equipment (inline fans, clip fans, carbon filters)
• Environmental controllers and monitoring devices
• Grow tents and controlled environment setups
• Irrigation and watering systems (drip irrigation, self-watering kits, hydroponic systems)
• Growing media, containers, and accessories (grow bags, Dutch buckets)

All products are sold exclusively for lawful agricultural and horticultural purposes as outlined in Section 1 of these Terms. All products and services are subject to availability and may be modified or discontinued at our discretion.

5. Quotation and Ordering Process

5.1 Quotation

• All quotations are valid for 30 days from the date of issue unless otherwise stated
• Quotations are provided as estimates and may be subject to adjustment based on site conditions, customization requests, or material cost changes
• A free initial consultation and site visit is provided to assess project feasibility

5.2 Order Confirmation

An order is confirmed when:

• You accept our written quotation
• You sign the purchase agreement
• You pay the required deposit (50% of total cost)

Once confirmed, the order enters our production queue and manufacturing begins.

5.3 Customization

Customization requests must be finalized before production begins. Changes requested after production has started may incur additional costs and delays.

6. Pricing and Payment Terms

6.1 Pricing

• All prices are quoted in Mauritian Rupees (MUR)
• Prices exclude 15% VAT unless explicitly stated otherwise
• Current pricing ranges:
  • Eco Domes: Rs 260,000 - Rs 310,000 (excl. VAT)
  • Grower Domes: Rs 245,000 - Rs 480,000 (excl. VAT)
  • Glass Domes: Rs 543,900 - Rs 930,000 (excl. VAT)
• Prices include dome structure, platform/decking, and standard installation
• Additional features, remote locations, and complex site preparation may incur extra charges

6.2 Payment Schedule

6.3 Payment Methods

• Bank transfer (preferred method)
• Payment details will be provided upon order confirmation
• All payments must clear before the next stage proceeds

6.4 Late Payment

Failure to make timely payments may result in:

• Suspension of production or installation
• Cancellation of the order
• Forfeiture of deposit (see Cancellation Policy)

7. Delivery and Installation

7.1 Timeline

• Manufacturing: 4-6 weeks after deposit payment
• Shipping to Mauritius: Included in timeline
• Installation: 1-2 weeks after final payment and delivery
• Total Timeline: Approximately 6-8 weeks from order to completion

These timelines are estimates and may vary due to weather conditions, customs clearance, site accessibility, or other unforeseen circumstances.

7.2 Site Preparation

Customer is responsible for:

• Ensuring site access for delivery vehicles and installation equipment
• Obtaining all necessary building permits and approvals
• Providing utility connections if required (electricity, water, sewage)
• Ensuring the site is cleared and ready for installation

We conduct a pre-installation site visit to assess requirements and provide guidance.

7.3 Installation

• Professional installation is included in all packages
• Our team will complete the dome assembly, platform construction, and basic setup
• Additional electrical, plumbing, or utility work may be provided as optional extras
• Customer must be available during installation for access and final approval

7.4 Delays

We are not liable for delays caused by:

• Weather conditions (cyclones, heavy rain, etc.)
• Customs or shipping delays
• Site access issues or unprepared sites
• Government restrictions or regulatory changes
• Force majeure events (natural disasters, pandemics, etc.)

8. Warranties and Guarantees

8.1 Product Warranty

We provide warranty coverage for:

• Structural framework against material and workmanship defects
• Panels and weatherproofing against manufacturing defects
• Installation quality and workmanship

Specific warranty terms and duration are provided in your purchase agreement.

8.2 Warranty Exclusions

Our warranty does not cover:

• Normal wear and tear
• Damage caused by misuse, negligence, or unauthorized modifications
• Damage from extreme weather events beyond design specifications
• Lack of proper maintenance
• Damage caused by third parties or acts of God

8.3 Cyclone Resistance

Our domes are engineered to withstand Category 4-5 cyclones (150-280+ km/h winds) when properly installed and maintained. However, we cannot guarantee protection against all extreme weather events or guarantee zero damage in all cyclone scenarios.

9. Cancellation and Refund Policy

9.1 Customer Cancellation

• Before Production Begins: Customer may cancel with 30 days written notice. Deposit is refundable minus 10% administrative fee
• After Production Begins: Deposit is non-refundable. Customer is liable for costs incurred to date
• After Delivery: No cancellations accepted. All sales are final

9.2 Company Cancellation

We reserve the right to cancel orders if:

• Payment is not received as scheduled
• Required permits or approvals are denied
• Site conditions make installation unsafe or impossible
• Customer provides false or misleading information

In such cases, we will refund payments received minus costs already incurred.

10. Limitation of Liability & Disclaimer

10.1 General Limitation

To the maximum extent permitted by the laws of the Republic of Mauritius:

• Our total liability shall not exceed the total amount paid by the customer for the specific product or service in question
• We are not liable for any indirect, consequential, incidental, special, punitive, or exemplary damages
• We are not liable for loss of profits, revenue, data, business opportunities, or any economic loss
• We are not responsible for delays or failures caused by circumstances beyond our reasonable control

10.2 Product Use Disclaimer

Dome Guys (Mauritius) Ltd sells horticultural and agricultural equipment. We do not control, monitor, or have any responsibility whatsoever for how customers use the products after purchase.

• We are not responsible or liable for any misuse of products by customers or any third parties
• We are not responsible for any damage, loss, injury, legal consequence, or penalty arising from the use or misuse of our products
• We are not responsible for the results, outcomes, or consequences of any agricultural or horticultural activities undertaken using our products
• We make no guarantees regarding crop yields, plant growth, or any specific agricultural outcomes
• The customer assumes all risk and responsibility for the use of purchased products

10.3 No Liability for Illegal Use

Dome Guys (Mauritius) Ltd shall bear absolutely no liability, responsibility, or obligation of any kind in the event that any product sold by the Company is used, directly or indirectly, in connection with any illegal, unlawful, or prohibited activity. The customer who purchases the product bears sole and exclusive responsibility for ensuring that the product is used in compliance with all applicable laws.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dome Guys (Mauritius) Ltd, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or in connection with:

• Your use or misuse of any products purchased from us
• Your breach of these Terms & Conditions
• Your violation of any applicable law or regulation
• Any illegal activity conducted using products purchased from our Company
• Any claim made by a third party related to your use of our products

This indemnification obligation shall survive the termination of any agreement between you and Dome Guys (Mauritius) Ltd.

12. Intellectual Property

• All designs, technical drawings, 3D renderings, and proprietary information remain the property of Dome Guys (Mauritius) Ltd
• Customers receive a license to use designs for their specific purchased dome
• Customers may not reproduce, distribute, or commercially exploit our designs
• Website content, images, and branding are protected by copyright and trademark laws

13. Permits and Legal Compliance

Customer is responsible for:

• Obtaining all necessary building permits from local authorities
• Ensuring the dome complies with local zoning and building codes
• Securing environmental clearances if required
• Compliance with all applicable laws and regulations

We provide technical drawings and specifications to support permit applications, but we do not guarantee permit approval. Permit denial does not constitute grounds for refund after production has begun.

14. Customer Responsibilities

By purchasing our products, you agree to:

• Provide accurate and complete information about your site and requirements
• Ensure site accessibility and preparation as specified
• Make timely payments according to the agreed schedule
• Maintain the dome according to provided guidelines
• Allow our team access to the site for installation and warranty service
• Not make unauthorized modifications that could compromise structural integrity

15. Website Use

When using our website, you agree to:

• Provide accurate information in contact forms and inquiries
• Not use the website for any unlawful purpose
• Not attempt to compromise website security or functionality
• Not harvest or collect user information without permission
• Respect our intellectual property rights

16. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Mauritius. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Mauritius.

18. Dispute Resolution

In the event of a dispute, we encourage customers to:

• Contact us directly to resolve the matter amicably
• Provide written notice of the dispute with full details
• Allow 30 days for negotiation and resolution attempts

If a dispute cannot be resolved through negotiation, either party may pursue legal remedies through the courts of Mauritius.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with your purchase agreement and our Privacy Policy, constitute the entire agreement between you and Dome Guys (Mauritius) Ltd regarding the purchase and use of our products and services.

21. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date.

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. For orders already in progress, the Terms in effect at the time of order confirmation shall apply.
